Texas Separates 26 Migrant Family Units at Border, Sparking Concern and Confusion
Texas has implemented a controversial policy that has led to the separation of at least 26 migrant family units at the southern border, causing alarm and confusion. The policy is part of Governor Greg Abbott’s Operation Lone Star border initiative, which aims to address the ongoing immigration crisis. However, critics argue that the practice is a harsh and cruel deviation from the asylum process.
According to immigration attorney Kristin Etter from Texas Rio Grande Legal Aid, the majority of her clients were Venezuelan asylum seekers who intended to surrender to US immigration authorities in a public park in Eagle Pass. Instead, they were redirected by Texas Department of Public Safety state troopers to different areas, where they were subsequently detained and families were separated.
Etter revealed that some of her clients reported instances where DPS officers cut through concertina wire to gain access and then arrested them once they passed through. Unlike previous family separations under the Trump administration’s zero tolerance policy in 2018, which primarily targeted parents, Texas is now separating men from their families.
The situation has caused significant distress and concern among affected families. Many have no knowledge of their children’s and partners’ whereabouts, resulting in a sense of despondency. In most cases, the father is arrested for criminal trespass under state law while the mother and her children are handed over to US Border Patrol agents.
Etter argues that these arrests are baseless, as the criminal trespass statute was not designed to target individuals for immigration violations. Furthermore, the border patrol agents’ attire, similar in color to Texas DPS troopers’ uniforms, has led to confusion among asylum seekers who mistakenly believe they are presenting themselves to immigration officers.
Instead of reuniting families in immigration custody as promised during the arrest, male clients have been taken to state prisons acting as jails. They face significant communication barriers with their families who are detained in immigration facilities. This represents a new approach by Texas DPS, and while the agency acknowledges family separations, it has not clarified its shift in policy.
Despite the criminal trespass arrests, these separated families can still pursue their asylum claims under federal law. The detentions may serve as a harsh detour in the asylum process, but they do not prevent families from eventually reuniting after release.
The measures implemented by Governor Greg Abbott along the Texas-Mexico border have raised concerns among Biden administration officials. These measures have disrupted US Border Patrol operations and put migrants at risk. Recently, the US Department of Justice even filed a lawsuit against Texas over the state’s use of floating barriers in the Rio Grande, which Abbott argues is an attempt to deter unauthorized border crossings.
