Racist slurs, such as variations of the N-word, monkey, and boy, were allegedly used casually and openly in high-traffic areas and worker hubs.

The commission revealed instances wherein Tesla supervisors and managers witnessed racial abuse but failed to intervene, while the company did not take appropriate measures to address the misconduct. Black Tesla workers who voiced concerns about racist treatment reportedly faced retaliation, such as being assigned undesirable duties or shifts, unjust disciplinary write-ups, or, in some cases, termination.

The EEOC lawsuit adds to discrimination claims previously filed by the state of California, individual Tesla employees, and a class action suit that involves approximately 240 workers. Tesla had acknowledged last year that the EEOC had expressed concerns about workplace conditions at the factory.

Tesla, in response to these allegations, has asserted its opposition to all forms of discrimination and harassment, underscoring its commitment to maintaining a safe, respectful, fair, and inclusive workplace. However, the company is yet to issue a statement regarding the EEOC’s most recent legal action.

Apart from the racial harassment claims, several female Tesla workers have filed lawsuits in 2021 alleging sexual harassment at the Fremont plant. These incidents compound the ongoing legal challenges faced by the company and raise questions about the effectiveness of Tesla’s internal policies and procedures in curbing discrimination.

As the court case unfolds, Black workers who felt wronged are seeking unspecified damages and compensation. They are joined by the EEOC in calling for an order that would require Tesla to address racism within its factory premises.

This latest lawsuit highlights the need for companies to prioritize diversity and inclusion efforts and to ensure that all workers are treated with fairness and respect, regardless of their race or gender.
