Russian troops have been facing allegations of widespread torture and war crimes in Ukraine, triggering an obligation to investigate the claims. The accusations, detailed in a letter by Dr. Alice Jill Edwards, describe horrifying human rights abuses by Moscow’s troops since Vladimir Putin’s invasion, including electrocutions, mock executions, and threats of genital mutilation. As a party to the UN Convention Against Torture and International Covenant on Civil and Political Rights, Russia is required to investigate the allegations.

Dr. Edwards sent a 22-page letter to Russian authorities to put them on notice regarding the extensive war crimes allegations. However, Russia has failed to formally respond to the warning within the two-month deadline and has ignored Dr. Edwards’ requests for a meeting to discuss the allegations. In response to Russia’s lack of action, Dr. Edwards expressed disappointment, stating that she had hoped for information on the steps Russia would take to prevent torture and launch investigations based on the evidence presented.

The allegations suggest that the torture practices carried out by Russian troops extend beyond the actions of a few rogue soldiers. Dr. Edwards claims that there is evidence of state authorization by Moscow, with FSB security agents reportedly supervising torture practices in multiple detention centers.

In her letter, Dr. Edwards warns Moscow that if proven to be systematic or widespread, the alleged acts of torture would constitute crimes against humanity. The letter is co-signed by UN special rapporteurs and working groups on arbitrary detention, enforced disappearances, extrajudicial executions, and the use of mercenaries.

The Kremlin has consistently denied accusations of war crimes committed by its troops in Ukraine. However, the prosecutor general’s office in Kyiv is currently reviewing over 98,000 reports of war crime allegations, highlighting the severity of the situation in the war-torn region.

According to the UN experts, Russian troops have specifically targeted Ukrainian civilians in occupied areas since the beginning of the invasion. This includes veterans, individuals supporting Ukraine’s armed forces, war critics, and local authority officials. The detainees are often seized without a warrant from their homes, workplaces, or even on the streets and at Russian military checkpoints.

Reports indicate that many civilians were blindfolded, threatened, insulted, and beaten during their detention. They were subjected to extreme conditions, including freezing temperatures, hunger, and inadequate access to toilet facilities. Russian authorities’ refusal to acknowledge these detentions has led to enforced disappearances, causing anguish among the local population, many of whom still do not know the fate or whereabouts of their loved ones.

The torture methods described by the detainees during their interrogations primarily aimed to obtain information about Ukraine’s military strategy or as punishment for supporting Ukraine’s forces. Methods allegedly included electrocution, beatings with truncheons, hammers, and mock executions. Detainees were threatened with sexual violence and exposed to cold and bright light. They were deprived of basic necessities such as food, clothing, and medication. Some individuals were beaten simply for identifying themselves as Ukrainian.

The UN experts emphasize that many detainees suffered physical and psychological trauma, including bruises, wounds, fractures, extreme weight loss, and impaired senses or motor functions. The victims require ongoing medical evaluation and treatment, leading to financial constraints for themselves and their families.

Dr. Edwards stressed the need for continued documentation and collection of forensic evidence to support potential future prosecutions of those responsible. At present, the consequences for Russia’s alleged violations of the torture prohibition primarily involve diplomatic and economic repercussions rather than legal actions.

Despite Russia’s denial of these allegations, it is crucial to address the serious human rights abuses reported in Ukraine. The international community and relevant actors must take a stand to ensure justice and accountability for the victims, as well as to prevent such actions from occurring in the future.
