Ninth Circuit Blocks California Law Banning Firearm Advertising to Minors, Citing First Amendment Concerns
In a recent development, the US Court of Appeals for the Ninth Circuit has issued a temporary block on a California law that prohibits firearm advertising directed towards minors. The law aimed to ban any advertisements that were deemed attractive to minors. However, the court has expressed concerns regarding its constitutionality, citing potential violations of the First Amendment.
Circuit Judge Kenneth K. Lee, the author of the opinion, argued that the law likely infringes upon the First Amendment rights. According to Lee, the law restricts truthful and lawful advertising without significantly advancing any substantial government interest. Although California has a legitimate interest in curbing gun violence and preventing minors from using firearms illegally, Lee found that the law extends to advertisements surrounding lawful activities, such as supervised hunting. As a result, the law could impinge on speech concerning lawful conduct without providing any misleading or deceptive information.
The Ninth Circuit’s decision overturns the US District Court for the Central District of California’s denial of a motion filed by Junior Sports Magazines, Inc. and several gun rights groups, who sought to block the implementation of the California law. The case has now been remanded for further proceedings.
Furthermore, Judge Lee highlighted that the California law goes beyond what is necessary by affecting advertisements targeting both adults and minors. He emphasized that there is no evidence to suggest that a minor in California has ever unlawfully purchased a firearm, let alone done so as a result of an advertisement.
The lawsuit against the California Attorney General was initiated in 2022 by the gun rights groups and Junior Sports Magazines, Inc. following the enactment of the law by Governor Gavin Newsom.
