Canada’s Expansion of Medical Assistance in Dying Faces Scrutiny as MPs Seek Oversight for Mental Illness Cases

The planned expansion of Canada’s medical assistance in dying (MAID) regime is set to face renewed scrutiny from Parliament. Members of Parliament (MPs) have agreed that more oversight is necessary to ensure the health-care system is ready to manage requests to end the lives of individuals with mental illnesses. This decision comes after a failed attempt by a Conservative MP to repeal the ability of people with mental disorders to access MAID.

Currently, Canadians with mental illnesses are scheduled to be able to seek MAID starting in March. The approaching deadline has sparked intense debate over the appropriateness of allowing access to MAID for this particular cohort of individuals.

The controversy surrounding the issue was evident in the House of Commons, where a few Liberals and many NDP MPs joined forces with the Conservatives to send MP Ed Fast’s Bill C-314 to committee for further study. However, the bill failed to pass, as the majority of Liberals and the Bloc Québécois voted against it.

Fast argued that there is no medical consensus on whether individuals with mental illnesses should have access to MAID. He also expressed concerns that the regime normalizes assisted death as an alternative treatment option. Additionally, proponents of the bill highlighted cases of people seeking MAID due to other factors, such as inadequate income support and housing, complicating their health concerns.

Initially, individuals whose sole underlying condition was a mental illness were expected to gain access to MAID in March 2023, following the passage of a law expanding access in 2021. Supporters of this path argue that careful assessments are conducted to determine the status of someone’s mental illness and that the existing law already incorporates appropriate safeguards.

The delay in implementing the expansion was attributed to factors such as the need for clinicians to develop practice guidelines and the pending final report from the special committee. This committee, composed of MPs and senators, has been working on MAID legislation since the government’s decision to expand Canada’s existing regime following a Quebec court ruling deeming certain elements of it unconstitutional.

When the committee’s final report was released in mid-February, it reiterated the interim conclusion that MAID should be expanded in cases of mental illness. However, it emphasized the need for oversight regarding the implementation of the new system. The committee recommended re-establishing itself to assess the preparedness for a safe and adequate application of MAID in situations involving mental illness.

According to the motion passed on Wednesday, the reconstituted committee has until January 31, 2024 to make any further recommendations.

Overall, the discussion surrounding the expansion of Canada’s medical assistance in dying regime continues, with MPs seeking greater oversight to ensure the appropriate management of requests from individuals with mental illnesses. The issue remains highly debated, with varied perspectives on whether this expansion is right for the country. As the parliamentary committee undertakes further study, the future of MAID for those with mental disorders remains uncertain.
