California Appeals Court Revives Lawsuits in Michael Jackson Abuse Cases

In a recent turn of events, the California appeals court has revived lawsuits from two individuals who accused the late pop singer Michael Jackson of abusing them as children. These claims were chronicled in the controversial HBO documentary ‘Leaving Neverland’. Wade Robson and James Safechuck will now have the opportunity to proceed with their claims against corporations owned by Jackson, alleging that these entities had a legal obligation to protect them from the alleged sexual abuse they endured during their childhood.

Previously, the lawsuits were dismissed by a Los Angeles Superior Court judge due to the statute of limitations. However, the recent ruling by the 2nd District Court of Appeal has overturned this decision, allowing Robson and Safechuck to pursue legal action against the corporations owned by Jackson. The court found it morally incorrect to excuse the corporations from their responsibility to ensure the safety of the plaintiffs, solely because they were owned by Jackson himself.

The justices rejected the corporations’ arguments that they could not be held accountable for the actions of Jackson, as they had no control over him or his interactions with children. Associate Justice John Shepard Wiley Jr. concurred with the decision, stating that treating the corporations as separate from Jackson would be a mere abstraction.

Both Robson and Safechuck initially attempted to bring their cases to court in 2013 and 2014. However, the lawsuits were dismissed at the time due to the statute of limitations. Fortunately for them, in 2020, a new law was enacted in California that extended the statute for child sexual abuse allegations. This gave them another opportunity to pursue justice.

Although their cases were dismissed once again in 2021, the recent ruling by three appellate court judges has opened the door for Robson and Safechuck to present their case in front of a jury in the lower courts. This renewed opportunity for justice brings hope for those who have endured abuse and seek accountability from abusers, regardless of their status in society.
