Southwest Airlines is facing a lawsuit over an incident of alleged racial discrimination. Mary MacCarthy and her 10-year-old daughter were flying from California to Colorado for a funeral when they experienced a distressing ordeal. According to the lawsuit filed in federal court, a Southwest flight attendant alerted the Denver Police Department, suggesting that MacCarthy may be a child trafficker because her daughter’s skin color didn’t match hers. The flight attendant never communicated with MacCarthy or her daughter during the flight. Upon landing at Denver International Airport, MacCarthy, who is white, was interrogated by two armed police officers while her Black daughter sobbed in fear. They were eventually released after MacCarthy showed her ID and explained their reason for traveling.
In response to the incident, MacCarthy and her daughter have filed a racial discrimination lawsuit against Southwest Airlines in the District Court of Colorado. They accuse the airline of discriminating against their mixed-race family and causing a traumatic incident that continues to affect her daughter. The lawsuit states that Southwest Airlines’ alleged display of racism led to extreme emotional distress for MacCarthy and her daughter. It further claims that this incident reflects the challenges faced by mixed-race families and families of color while traveling.
According to the complaint, Southwest Airlines has a history of racial profiling incidents involving mixed-race families. In one instance from January 2021, a white man named Luca Guerreri, traveling with his Black daughter, was pulled off a Southwest flight on suspicion of human trafficking. Guerreri subsequently lodged a complaint against the airline.
MacCarthy and her daughter argue that Southwest Airlines has failed to address the racial assumptions made by its employees about mixed-race families traveling together. The airline declined to comment on the ongoing litigation.
