The victim, Daniel Matta, provided a sworn statement detailing the events that unfolded. Matta claimed that he was driving on Interstate 4 when he noticed a Jeep weaving in and out of traffic and honking its horn. To avoid any potential danger, Matta moved to the far-right lane to let the Jeep pass. However, the Jeep decided to drive around him on the passenger side by taking the right shoulder. Matta slowed down to avoid the firearm and ended up behind the suspect vehicle as they both approached Exit 83. Matta took photographs of the Jeep as it turned right onto College Park Drive and began driving recklessly. He then called 911 and provided the vehicle information to the dispatcher, expressing the urgency as he needed to get to work.
Law enforcement created a photo lineup using the suspect’s Florida driver’s license picture and presented it to Matta, who quickly identified Cash Wheeler as the alleged perpetrator with certainty. Based on Matta’s sworn statement and the positive identification made from the photo lineup, there is sufficient probable cause to charge Wheeler with aggravated assault with a firearm violation.
