Woman Sues Eataly for Fractured Ankle After Slip on Prosciutto – $50K Damages Expected

A woman from New Hampshire is suing Eataly, the popular Italian marketplace and restaurant, after she allegedly slipped on a piece of prosciutto and fractured her ankle. The incident occurred last fall at the Eataly location in Boston’s Prudential Center. The woman claims that her injuries have resulted in approximately $50,000 in damages.

According to the lawsuit filed in Suffolk Superior Court, the woman and her husband were visiting Eataly on October 7 when they spotted a free samples area and decided to check it out. As they approached the area, the woman slipped and fell on a slice of prosciutto that was on the floor, causing her to injure her left ankle and resulting in a fracture.

The lawsuit alleges that Eataly was negligent in maintaining its premises in a safe condition, thus failing to fulfill its duty of care to visitors. It states Eataly should have ensured that its floors were free from any potential dangers or provided adequate warnings about potentially slippery conditions, including those caused by thin slices of Italian ham.

In addition to the woman seeking damages for her injuries, her husband is also named as a plaintiff in the lawsuit. He claims to have suffered a loss of consortium due to his wife’s initial hospital stay and subsequent physical therapy.

The couple has submitted evidence of their medical expenses, which currently amount to $2,274.68 for hospital bills and $5,265 for physical therapy. They are seeking compensation for these costs, as well as additional damages. The plaintiffs believe they can prove to a jury that the fall warrants a minimum award of $50,000.

At this time, it remains unclear how the woman specifically identified the prosciutto as the cause of her fall. However, the lawsuit emphasizes that Eataly had a responsibility to maintain a safe environment for the general public and should have taken measures to prevent accidents like this from happening.

Eataly has not yet issued a public statement regarding the lawsuit. It is important to note that this is only one side of the story, and it will be up to the court to determine the validity of the claims presented.

As the legal proceedings continue, it serves as a reminder for businesses to prioritize the safety of their customers by promptly addressing potential hazards and maintaining a vigilant approach to ensuring a secure environment.
