Eataly Faces Lawsuit After Woman Slips on Prosciutto: Seeking $50K+ in Damages

A woman in Boston has filed a lawsuit against popular Italian food emporium Eataly, alleging that she suffered a fractured ankle after slipping on a slice of prosciutto. Alice Cohen, 67, initiated legal action against the restaurant, claiming that the incident occurred while she was making her way to a section offering food samples. The lawsuit, filed in Suffolk Superior Court on August 11, seeks damages of at least $50,000.

According to court documents, the incident not only caused physical injuries to Cohen but also resulted in medical expenses exceeding $7,500 and a loss of enjoyment of life. Cohen’s husband, Ronald, from Gilford, New Hampshire, accompanied her and they are both pursuing a jury trial.

The lawsuit alleges that Eataly was negligent in maintaining the safety of its premises by failing to take proper measures to clean the floor. It further claims that the restaurant has an obligation to provide a safe environment for its customers. Additionally, the suit includes a claim for loss of consortium.

Eataly, renowned for its gourmet Italian offerings with locations across the US and overseas, has yet to issue a comment regarding the lawsuit. The popular restaurant chain is now facing legal repercussions for an incident that occurred on October 7. As the case unfolds, both sides will present their arguments in court, and a jury will ultimately determine if Eataly bears responsibility for Cohen’s injuries.

Slipping accidents can result in serious injuries and significant medical expenses. Maintaining the safety of establishments, especially those offering samples and food displays, is essential to prevent such incidents. This lawsuit serves as a reminder for businesses to prioritize the safety of their premises to avoid facing legal consequences.

In light of this incident, Eataly may face reputational damage, and potential customers might be more cautious when navigating the restaurant. Regular and thorough cleaning practices and vigilance in maintaining a safe environment are crucial for businesses operating in the hospitality industry.

The outcome of this lawsuit will not only impact Eataly’s reputation but also set a precedent for similar cases in the future. As customers, it is essential to remain attentive and aware of potential hazards when visiting any establishment.
