Delhi High Court Grants Divorce in Case of Wife’s False Police Complaint

The Delhi High Court recently granted a divorce to an estranged couple due to the wife’s false police complaint, which resulted in mental harassment and trauma for the husband. The court emphasized that the prospect of being summoned to a police station is akin to a Damocles’ sword hanging over the husband’s head, causing severe cruelty in the relationship.

In this case, the wife had filed a police complaint alleging cruelty by her husband and his family, even falsely claiming that her father-in-law had attempted to rape her in the presence of her mother-in-law. However, all the accused were subsequently acquitted by the trial court.

The bench, led by Justice Suresh Kumar Kait and Justice Neena Bansal Krishna, stated that making false allegations and constantly threatening to summon someone to a police station can severely impact a person’s mental balance and constitute acts of cruelty. The court acknowledged that a police station is not a pleasant place to visit, as it serves as a source of mental harassment and trauma for the person involved.

The court also took into consideration that the couple had been living apart for almost 17 years, which the Supreme Court recognizes as a valid ground for divorce. Granting the divorce decree was deemed crucial in this case, as the current situation had become disastrous for both parties. The court believed that a ray of hope might exist for the parties to psychologically and emotionally settle down and begin anew after obtaining a divorce.

The lack of reconciliation options, coupled with the long separation period filled with false allegations, police reports, and a criminal trial, constituted a source of mental cruelty. Insisting on continuing the relationship would only inflict further cruelty on both parties. The court concluded that there was a complete breakdown of faith, trust, understanding, and love between the couple, making it unreasonable to expect them to live together anymore.
