Judges in England and Wales can now utilize OpenAI’s ChatGPT to write rulings, marking a significant step in incorporating artificial intelligence (AI) into judicial procedures in the country. The UK Judicial Office recently issued guidance endorsing the use of AI, citing its potential benefits in the drafting of judgments among other applications.
The guidance, a six-page document, addresses various concerns related to the use of AI by judges. It emphasizes the importance of maintaining confidentiality, privacy, accuracy, and preventing bias. While AI has demonstrated its efficacy in various fields such as task automation, data analysis, and medical diagnosis, its utility in the legal sector remains less certain.
AI exhibits competence in summarizing large volumes of text but faces challenges when it comes to complex legal concepts and language. Additionally, AI chatbots often struggle with reasoning and comparison, prompting the guidance to advise judges against relying on AI in these areas. However, simpler tasks like composing emails and seeking presentation suggestions are considered viable AI applications in the judicial process.
The integration of AI in the judiciary is a notable development, as the legal sector has traditionally remained somewhat detached from technological advancements. This separation is partly attributed to incidents where AI-generated content contained fictitious information. Notably, two lawyers were fined $5,000 for citing fake cases in their arguments, with the blame falling on Microsoft-supported OpenAI’s ChatGPT for erroneously fabricating the non-existent cases.
Generative AI chatbots have occasionally produced false or hallucinatory information due to their ability to generate content creatively. Given the critical nature of the legal system, such errors are unacceptable. Ensuring the accuracy and integrity of legal proceedings remains of utmost importance.
As the judiciary in the UK embraces AI, precautions must be taken to mitigate the risks associated with the use of AI technology in the legal process.
