Three Men Fined RM4,500 for Assault in Kota Kinabalu

Kota Kinabalu: Three men have been fined a total of RM4,500 by the Magistrate’s Court for assaulting a man in Penampang two weeks ago. The incident took place at the Hot Kitchen Café and Bar at 3.40am on October 8. The men, identified as trader Sahrul Nizam Ibrahim, hairstylist Razali Jubri, and mechanic Md Riduwan Abdul Haling, pleaded guilty to voluntarily causing hurt to Md Pirdaus Ramas, 23. They were each fined RM1,500 or four months in jail.

The trio was jointly charged under Section 323 of the Penal Code, which carries a maximum jail term of one year or a fine of up to RM2,000, or both, upon conviction. Prior to the assault, the complainant had gone to the premises to find his friend when he was shoved out by an unknown man. Moments later, one man punched the complainant’s left cheek, and the other two joined in, causing injuries to his nose and head.

Duty counsel Lim Ming Zoong @ Lawrence, representing Sahrul and Riduan, and counsel Carmen Khoo, representing Razali, requested leniency, emphasizing that it was their first offense.

Separately, Sahrul also faced another charge of committing mischief. He pleaded not guilty to damaging property, including tables, chairs, a sound system, two televisions, and an air conditioner belonging to Rayner Robert, at Aramai Frienz, Kepayan Point, Penampang Bypass, on September 9. The accused was allegedly involved in this offense under Section 427 of the Penal Code, along with several accomplices.

Inspector Kelvan Elson Maik, prosecuting, proposed bail at RM4,000 in two sureties for Sahrul. He was granted bail at RM1,700 in two sureties pending the mention of the case on November 30.

In another case, a 30-year-old cashier was fined RM100 or three weeks in jail for fraudulently depositing RM6,000 into her bank account last year. Eco Mirfannya admitted to having the money that belonged to Adela Wong in her Public Bank account. She failed to provide a satisfactory explanation of how she obtained the funds at 1.37pm on August 8, 2022.

The offense committed by Eco Mirfannya falls under Section 22A (1) of the Minor Offences Ordinance, which provides for a fine of up to RM100 or up to three months’ imprisonment, or both, upon conviction.

These cases highlight the importance of respecting the law and the consequences of engaging in criminal activities. The court’s decision to impose fines and penalties sends a clear message that such behavior will not be tolerated in Kota Kinabalu.
