Power to Summon Accused Should be Used by Court After Satisfaction on Evidence: SC

Indian courts cannot mechanically summon an accused person during a trial, states a ruling by the Supreme Court. Section 319 of the Criminal Procedure Code allows a court to take action against the accused person. However, the court should be satisfied with the evidence and believe it would lead to conviction. The ruling came after a plea by Jitendra Nath Mishra against the Allahabad High Court's decision to not cancel a summoning order in a case concerning assault and abuse under the SC/ST Act. The Supreme Court dismissed the appeal and advised the Special Court to expedite the trial, remaining uninfluenced by the Section 319, CrPC order upheld by the High Court and the Supreme Court.
