The Law Commission of India has cautioned against social evils like child marriage, sati, and triple talaq that take refuge as religious customs and seek protection under the law. Previous consultation papers by the commission have emphasized the need for reform of family law to prevent the continuation of these practices. The 22nd Law Commission has initiated fresh consultations on uniform civil code, which is a politically-sensitive subject. The commission has stated that despite previous court orders, there is still a need to deliberate on this subject and consider reform. The commission’s consultation paper has emphasized that these practices do not conform with basic human rights and are not essential to any religion. While freedom of religion and the right to practice and propagate religion must be protected, these social evils should not be protected under the law as religion.
