Public Smoking Concerns in Gelephu Raise Alarm for Visitors and Residents

Smoking in public places is strictly prohibited by law in Bhutan. However, a concerning trend has emerged in Gelephu, where public smoking is rampant. This has raised alarm among both residents and visitors, as they worry that people from neighboring countries might adopt this behavior, thinking it is acceptable in Gelephu.

Residents of Gelephu are calling for intensified monitoring and enforcement efforts to curb public smoking. While individuals have the right to smoke, they should also respect non-smokers by refraining from smoking in public areas. The bad impression created by public smoking among expats and visitors is a growing concern among the residents.

One resident, Kezang Tshomo, emphasized the need for stricter penalties and increased public awareness. According to her, while people become more vigilant during inspections, they tend to forget about the issue afterward. Therefore, raising awareness among the public is crucial for the effective implementation of the law.

Residents have also noticed a concerning accessibility of cigarettes and tobacco products in most shops, with some vendors even allowing customers to smoke on their premises. Furthermore, the absence of No Smoking signs in many shops has contributed to the prevalence of public smoking.

An official from the Bhutan Food and Drug Authority expressed their disappointment with the continued occurrence of public smoking despite ongoing advocacy and sensitization programs. According to the Tobacco Act, any area with more than two people is considered a public place, and smoking is strictly prohibited. The official suggested the establishment of designated smoking zones within entertainment venues, hotels, restaurants, and snooker rooms. However, there are currently no designated areas in open spaces, which leaves smokers uncertain about where they can smoke.

Although the Bhutan Food and Drug Authority faces a shortage of manpower, they plan to send inspectors to Gelephu for surprise inspections. The authority will also request the police to enforce the provisions of the Tobacco Act more vigilantly.

Police officials acknowledge that the absence of designated smoking zones leads people to smoke in their preferred open areas. They emphasize that advising against smoking in public places is a shared responsibility, but hesitancy arises due to uncertainty about how smokers may react.

According to the Tobacco Act, if someone is found smoking in a place other than the designated area, they should be requested to refrain from smoking by the person in charge. If the person continues to smoke, the offender can be asked to leave the place or transport, or reported to an authorized officer or law enforcement personnel.

Agencies and institutions failing to display No Smoking signs will be subject to a fine of Nu 1,000, while individuals smoking in restricted areas may face a fine of Nu 500. Moreover, the person responsible for the premises will be fined Nu 1,000 per person found smoking on the premises.

In July 2021, the Bhutanese government amended the Tobacco Act, allowing for the sale of tobacco products in grocery stores and ‘pan shops’. However, it is important to note that the amendment does not permit smoking in public places. The responsibility of overseeing and penalizing those who smoke in public spaces lies with the erstwhile Bhutan Narcotic Control Authority and the Royal Bhutan Police.

In conclusion, the issue of public smoking in Gelephu has raised concerns among residents and visitors alike. Stricter enforcement, increased public awareness, and the establishment of designated smoking zones are necessary to tackle this problem effectively. By adhering to the provisions of the Tobacco Act, individuals and authorities can work together to create a smoke-free environment that promotes the well-being of all.
