Prosecutors Seek Gag Order on Ex-President Trump’s Inflammatory Statements in Election Subversion Trial

The US special counsel prosecuting Donald Trump for election subversion has requested a limited gag order on the former president’s public statements. Citing Trump’s frequent inflammatory attacks on the court, prospective witnesses, and citizens of Washington DC, federal prosecutors have asked judge Tanya Chutkan to impose restrictions.

In their filing on Friday, prosecutors asked for a narrow gag order that would prohibit Trump from making statements that could potentially harm the identity, testimony, or credibility of prospective witnesses. The order would also prevent him from making disparaging and inflammatory remarks about any party, witness, attorney, court personnel, or potential jurors.

The request comes after Trump’s consistent public attacks on various individuals and institutions, particularly on his social media platform, Truth Social. His posts have included claims that the justice system is rigged against him, attacks on the district of DC as filthy and crime ridden, and direct insults aimed at Judge Chutkan. These inflammatory statements have raised concerns about the integrity of the trial and the safety of those involved.

Prosecutors argue that Trump’s attacks on social media have previously incited violence towards the subjects of his vitriol. They claim that the defendant knows that when he publicly attacks individuals and institutions, he inspires others to perpetrate threats and harassment against his targets.

Judge Chutkan, in a previous warning to Trump’s legal team, urged them to take special care in their public statements about the case. She vowed to take whatever measures necessary to safeguard the integrity of the proceedings.

Simultaneously, unsealed filings revealed that Twitter (now known as X) provided prosecutors with at least 32 of Trump’s private messages. This new development adds another layer of complexity to the ongoing proceedings.

Repeated violations of gag orders in criminal cases can have severe consequences, including potential jail time for defendants. The trial is set for March 2024, with Trump facing charges of conspiracy to defraud the US, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights.
