Ohio School Board Sues State over Education Law Amid Allegations of Transparency Violation
The Ohio School Board has taken legal action against the state in response to an impending education law that grants increased powers to the legislature. This law, set to come into effect on October 3, restructures the education department and strips the Ohio Board of Education of its authority. Lt. Gov. Jon Husted supports this restructuring, pointing out the State School Board’s inability to pass resolutions and hire a new State Superintendent. However, seven members of the school board have filed a lawsuit arguing that the restructure violates the Ohio constitution and will compromise transparency in the decision-making process.
Teresa Fedor, one of the plaintiffs in the lawsuit and a member of the Ohio School Board, raises concerns about the potential decrease in transparency. She contends that the restructuring will hinder public involvement and accountability, remarking that the process of translating laws into rules, regulations, and standards for Ohio schools will no longer be public. Fedor sees this lack of transparency as undemocratic and authoritarian.
Both sides acknowledge the importance of accountability, yet they differ on who should be held responsible. Lt. Gov. Husted places blame on the State School Board for their perceived inability to accomplish the necessary work. On the other hand, Fedor believes that accountability should fall upon the Governor’s office.
