Man Found Guilty of Killing Girlfriend’s Son in Blount County: Receives Life Without Parole Recommendation
A man in Blount County, Alabama, has been convicted for the murder of his girlfriend’s 18-month-old son and the abuse of another child. Robert Keith Elmore Jr., 32, was found guilty of capital murder in the 2019 death of Enzo McCormack and aggravated child abuse for the injuries sustained by Jessie McCormack, Enzo’s brother.
The trial, which began on September 28, concluded on October 6 with the jury’s verdict. The sentencing phase took place from Monday to Tuesday, during which the jury recommended a life sentence without the possibility of parole for Elmore.
Enzo McCormack tragically lost his life in 2019, three days after sustaining severe injuries while in Elmore’s care. When emergency medical personnel arrived at the scene, Enzo was unresponsive and in respiratory distress. Despite their efforts, Enzo passed away a few days later.
During the trial, it was revealed that Enzo’s mother, Samantha McCormack, is also awaiting trial, which is scheduled for 2024. She remains in custody without bond.
The incident that led to Enzo’s injuries occurred on September 6, 2019, when Blount County authorities responded to a 911 call reporting an unresponsive child at Locust Fork Hardware Store. Enzo’s mother claimed that she heard a thump in the living room while she was using the restroom and found Enzo choking on a piece of cereal upon her return.
Enzo’s injuries were determined to be the result of blunt force trauma and severe acceleration and deceleration injuries from violent shaking, according to Dr. Michael Taylor, who examined the child. In addition to Enzo’s death, Jessie McCormack also suffered abuse and was hospitalized. Jessie’s injuries included a skull fracture with arterial bleeding and swelling under the scalp.
Elmore’s telephone records, which were presented as evidence during the trial, showed that he sent a message to the mother of the children on the day of the incident informing her that Enzo was in distress. Prosecutors argued that Elmore intentionally and violently shook the child, subjected him to blunt force trauma, and willfully denied him proper medical care to ensure his death.
Blount County District Attorney Pamela Casey expressed her respect for the jury’s verdict and their commitment throughout the trial. She acknowledged the difficulty of the case due to the brutality inflicted upon the innocent children and expressed appreciation for the jurors’ attention and dedication. The verdict was reached based on the evidence presented during the trial.
