Man Charged with Killing Dublin Pensioner Found Unconscious in Fairview
A 23-year-old man is set to stand trial for the killing of a pensioner in Dublin. Charles McCaughley, a 69-year-old grandfather, was found unconscious on the ground in Fairview Strand and later died from severe head injuries. The incident occurred in June 2021, and a lengthy investigation by Clontarf Garda station led to the recent charges against the accused, Josh Rush.
During the evening sitting of Dublin District Court, Rush was charged with the unlawful killing of Mr. McCaughley on June 7th, 2021. Detective Sergeant David Ennis stated that Rush remained silent after being charged. The Director of Public Prosecutions has directed his case to proceed to trial on indictment in the Circuit Court.
The court granted an adjournment for the preparation of a book of evidence, which must be served on the accused before a trial order can be issued. Bail was not opposed, but Judge Cephas Power imposed several conditions. Rush was ordered to surrender his passport and ID cards, not apply for duplicates or travel documents, provide the police with a contact mobile number, be available 24/7, keep his phone switched on, and report any changes of address.
Mr. Rush, who has not yet entered a plea, remained silent during the court hearing. He was granted legal aid after his defense solicitor, Aoife McNicholl, submitted a statement of Rush’s means, revealing that he is on social welfare and supports two children.
The next court appearance for Mr. Rush is scheduled for October 4th, where he will face the charges against him.
