Maharashtra Deputy CM Proposes GST Increase to 28% for Online Gaming and Betting, India

Mumbai, Dec 7 – Maharashtra Deputy Chief Minister Ajit Pawar presented an amendment bill in the state assembly today, proposing that online gaming, betting, casinos, horse racing, and lottery be included in the highest Goods and Services Tax (GST) bracket of 28 percent. The bill aims to amend the Maharashtra Goods and Services Tax Act, 2017, and will be discussed during the ongoing winter session of the state legislature. If approved by the lower house, it will then proceed to the Legislative Council for voting and final approval.

The move comes as Pawar, who also holds the finance portfolio, seeks to regulate and potentially generate greater revenue from the gambling and gaming industry. By placing these activities in the 28 percent GST bracket, he hopes to curtail the growing popularity of online gaming platforms and address any potential negative social impact.

The proposed amendment bill aims to align Maharashtra’s taxation laws with those of other states in India that already consider these activities as taxable under the highest GST bracket. The move is also in line with the central government’s efforts to standardize tax laws across the country.

Industry experts and stakeholders have mixed views regarding the proposed amendment. While some believe that taxing these activities at a higher rate could discourage participation and impact revenue generation, others argue that it is a necessary step to address the growing concerns surrounding problem gambling and addiction.

Dr. Sameer Patil, an expert in gambling psychology, believes that taxing gaming activities at a higher rate can act as a deterrent and help control the rise of addiction. He states, By increasing the tax rate on these activities, we are discouraging impulsive gaming behavior. It could potentially reduce problem gambling and promote responsible gaming practices.

On the other hand, representatives from the gaming industry express concerns about the potential negative impact on the sector’s growth. They argue that such a high tax rate may force gaming platforms to pass on the burden to consumers, which could lead to a decline in user engagement and revenue.

Rajesh Gupta, CEO of an online gaming platform, cautions that imposing the highest GST bracket on the gaming industry might hamper its growth potential. It is essential to strike a balance between taxation and fostering a conducive environment for the industry to thrive. High taxes may lead to price increases for consumers and subsequently lower participation rates.

The amendment bill is expected to generate significant discussion during the ongoing winter session of the state legislature, as members deliberate on the potential ramifications of such a move. The finance ministry anticipates that the proposed amendment, if passed, will contribute to increased tax revenues for Maharashtra, further bolstering the state’s economy.

It is worth noting that this development aligns with the Indian government’s push to regulate and tax the previously unregulated online gaming, betting, and lottery sectors. By treating them as taxable activities under the highest GST bracket, the government aims to create a fair and transparent regulatory framework for these industries.
