Madras High Court Judge Calls for Consideration of Conjugal Visits for Prisoners

In a recent development, Justice S.M. Subramaniam of the Madras High Court has urged the State government to contemplate allowing prisoners to have conjugal relationships with their spouses within prison premises. The judge made this request along with several other suggestions after conducting a surprise inspection at the Puzhal Central Prison, the largest central prison in Tamil Nadu.

During the inspection, Judge Subramaniam, accompanied by the Tiruvallur Principal District Judge and the Chief Judicial Magistrate, expressed concern over 38 prisoners who had not been released despite obtaining bail due to their inability to provide sureties. In response, the judge directed the Tamil Nadu State Legal Services Authority (TNSLSA) to modify the bail orders to ensure the prisoners could be released by providing their own bond, as per a Supreme Court directive.

Furthermore, the judge emphasized the importance of providing legal assistance to prisoners who cannot afford private lawyers and asserted that foreign nationals held in state prisons should have the right to contact their relatives and friends. Additionally, Justice Subramaniam highlighted the need for the premature release of prisoners with chronic illnesses and disabilities, as well as the provision of timely escort facilities for transporting sick prisoners to government hospitals.

Addressing the infrastructure and hygiene conditions within prisons, the judge proposed the establishment of play schools and the provision of toys, an entertainment area, milk, biscuits, and health drinks for children under six years who are allowed to stay with their mothers in prison.
