Kyrgyzstan’s Proposed NGO Law Amendments Raise Concerns about Civil Society’s Freedom

Kyrgyzstan’s parliament has recently approved amendments to the country’s NGO law, sparking fears over the potential restriction of civil society’s freedom and the ability of non-governmental organizations (NGOs) to operate effectively. The bill, which has been passed in its first reading, introduces several controversial provisions that could have far-reaching consequences.

One of the main areas of concern is the imposition of compulsory labels such as ‘foreign representative’ and ‘Foreign NGO’ (FNGO) on organizations that receive foreign funding. This labeling, along with burdensome reporting requirements, could lead to increased state control over NGOs and stigmatization of their activities. Such labeling has been exploited in other countries to severely constrain NGOs, putting them at risk of attacks and undermining their ability to provide essential support to vulnerable individuals.

Amnesty International’s Central Asia Researcher, Maisy Weicherding, expressed disappointment with the passing of these restrictive amendments and called on the parliament to consider the socio-economic benefits of a thriving civil society. Weicherding highlighted the importance of NGOs in supporting people’s access to their rights and urged the parliament to reconsider the amendments’ impact.

The proposed amendments also introduce severe penalties for civil society activists involved in the establishment, participation, or promotion of NGOs or affiliated foreign NGOs. Activists could face up to 10 years’ imprisonment if authorities deem that the organization incites citizens to refuse civic duties or commit other unlawful deeds, a term that is vaguely defined. This provision raises concerns about the potential criminalization of legitimate civil society activities.

Furthermore, the amendments grant authorities the power to suspend an NGO’s activities for six months without a court decision or exclude it from the register if it fails to register as a foreign representative. This could effectively shut down organizations that are unable or unwilling to comply with the new regulations. The Ministry of Justice would also be empowered to prohibit NGOs from providing funds to certain organizations deemed to harm the country’s interests, further limiting the ability of NGOs to support causes they deem important.

The amendments also discriminate against foreigners, stateless individuals, and people with psychosocial disabilities by prohibiting their registration of NGOs. This denial of civil rights raises concerns about equality and inclusivity within the country.

While the proposed amendments aim to regulate and supervise NGOs operating in Kyrgyzstan, critics argue that they pose a significant threat to civil society’s freedom. A thriving civil society plays a crucial role in any country, particularly in times of economic and climate crises. The ability of NGOs to operate freely and without fear is a valuable asset that should be upheld and protected.

As the amendments proceed to the second reading, it is important for the Kyrgyzstani parliament to carefully consider the potential consequences. Balancing the regulation of NGOs with the preservation of civil society’s freedom is essential to ensure the country’s continued development and respect for human rights. Parliament should reject the proposed amendments and seek alternative approaches that promote transparency, cooperation, and the protection of civil society’s vital role.
