Justice Department Files Lawsuit against Texas Governor Abbott over Unauthorized Border Barrier
The Justice Department has taken legal action against Texas Governor Greg Abbott over an unauthorized border barrier constructed on the Rio Grande. The lawsuit, filed on Monday, seeks a court order for Texas to dismantle the bright orange buoys, which were installed without permission and serve as part of the governor’s strategy to prevent migrants from entering the US from Mexico.
According to the lawsuit, the barrier, stretching approximately 1,000 feet and incorporating razor-wire fencing, was unlawfully erected between the border cities of Eagle Pass and Piedras Negras, Mexico. It accuses Texas of violating the law and demands the removal of the barrier.
Governor Abbott had already prepared for the legal battle by sending a letter to President Joe Biden earlier on the same day. In the letter, Abbott defended Texas’ right to erect the barrier and criticized the president for failing to adequately address the issue of migrant arrivals, claiming that Biden’s actions have put migrants at risk.
The Biden administration has argued that illegal border crossings have significantly decreased since implementing new immigration restrictions. White House press secretary Karine Jean-Pierre stated that Governor Abbott’s policies have obstructed the efforts of US Border Patrol agents to access the river and called his actions unlawful and unhelpful.
Last week, the Justice Department sent a letter to Texas, giving the state until Monday to comply with the removal of the barrier, or else face legal consequences. The letter highlighted concerns about navigational safety in the Rio Grande River and emphasized the humanitarian implications of the barrier.
The state authorities assert that the buoys were deployed with the approval of either the International Boundary and Water Commission or the US Army Corps of Engineers. However, Mexico’s secretary of state has requested the intervention of the federal government, arguing that the barrier violates international treaties.
