Judge Orders Lawyers to Submit Proposals in FOIA Complaint Against Washington County

A judge presiding over a Freedom of Information Act (FOIA) complaint against Washington County officials has given attorneys representing both sides 20 days to submit written proposals before ruling in the case. Circuit Judge William R. Wright of Hope heard arguments on Monday from lawyers Jason Owens and Steve Zega, representing the county and Beth Coger, respectively. The judge instructed the attorneys to email their proposals by August 28.

Beth Coger, a Washington County resident, community activist, and justice of the peace, filed a lawsuit against the county, county judge, and other officials on November 10. The complaint accused the defendants of failing to notify the public about meetings of the county’s Job Evaluation/Salary Administration Program Committee and not complying with Coger’s records requests under the FOIA.

On December 29, Judge Wright ruled that the Job Evaluation/Salary Administration Program Committee is a public body, and its meetings should be open to the public. He also awarded Coger approximately $1,000 in court costs. However, Jason Owens argued on Monday that the ruling was not a final judgment as required by law. Owens contended that the order did not address all the issues raised in the case, including a motion by the defendants to dismiss the complaint. Due to the absence of a final judgment, Owens argued that the demand for payment to Coger should be set aside.

Steve Zega, representing Beth Coger, argued that Arkansas law sets specific time limits for challenging or amending court rulings, and those time limits have expired in this case. Zega maintained that the order issued by Judge Wright qualifies as a final, applicable order and should be considered a judgment. Additionally, Zega requested the judge to order the county to pay his fees in the case.

Beth Coger expressed her frustration with the county’s lack of transparency and refusal to provide information about county government to the public. She revealed that she had spent years pleading with the county before resorting to filing her lawsuits.

Judge Wright’s decision to allow written proposals from both parties indicates that he wishes to thoroughly review the case before making a ruling. This approach ensures that all relevant arguments and legal aspects are considered. By granting attorneys an opportunity to present their proposals, the judge is ensuring a fair and comprehensive assessment of the case.

It remains to be seen how the judge will rule on the FOIA complaint against Washington County officials. As the legal proceedings continue, both sides will have the opportunity to present their positions and arguments in writing. The outcome of this case could have implications for future adherence to FOIA regulations and transparency in county government.
