IT Ministry Issues Advisory to Social Media Platforms to Combat AI-generated Fake Content, India

New Delhi, November 7: The IT Ministry has taken proactive measures in combating the spread of AI-generated fake content on social media platforms. In response to the recent controversy surrounding a morphed video of actor Rashmika Mandanna, which went viral online, the Ministry has issued a crucial advisory to major platforms such as Facebook, Instagram, and YouTube.

The advisory sent by the Ministry of Electronics and Information Technology (MeitY) emphasizes the need for social media platforms to promptly remove any fake content that is generated using artificial intelligence (AI) within 24 hours. By reiterating the existing legal provisions that platforms must follow as online intermediaries, MeitY aims to hold them accountable for their role in curbing the dissemination of misleading and harmful content.

Specifically, the advisory refers to the Information Technology Act, 2000, and its associated rules. Violations of these rules can result in severe consequences for platforms, including imprisonment of up to three years and a fine of up to Rs 1 lakh. Rule 3(1)(b)(vii) of the IT Intermediary Rules underscores the importance of due diligence on the part of social media intermediaries. This includes ensuring that their rules, regulations, privacy policies, or user agreements explicitly prohibit the hosting of content that impersonates another person.

Recognizing the impact of deepfake technology on individuals’ privacy and security, the Congress party has also voiced concerns and called for a comprehensive legal and regulatory framework in India. The emergence of deepfake content threatens not only public figures but also ordinary citizens, as demonstrated by the recent cases involving Rashmika Mandanna and now actress Katrina Kaif from the movie ‘Tiger 3.’

The IT Ministry’s advisory serves as a reminder to social media platforms of their responsibility to combat AI-generated fake content, maintain user safety, and protect individual identities. By enacting stringent measures, the government aims to restore trust and safeguard the online space from the detrimental effects of misinformation and impersonation.
