Israeli Parliament Passes Law Limiting Supreme Court’s Power

Israel’s parliament has recently passed a new law that restricts the power of the Israeli Supreme Court. The law includes provisions that prevent judges from striking down government decisions on the grounds of being extremely unreasonable. This move effectively limits the Supreme Court’s ability to review decisions such as the termination of officials based on their alleged unreasonableness.

The law, which is part of a larger plan backed by Prime Minister Benjamin Netanyahu to restructure the judiciary, was passed with overwhelming support in a 64-0 vote. Opponents of the law chose to walk out rather than voting against it. The first procedural vote was also in favor of the law, with a vote of 64-56.

Justice Minister Yariv Levin, who designed the plan, believes that this is just the first step in an important historic process of overhauling the judiciary. The plan also includes a bill that would allow a majority of the parliament to overturn Supreme Court decisions, as well as a law that would grant parliament the power to select judges.

However, the Movement for Quality Government, an organization that opposes the law, has quickly raised concerns over its constitutionality. They have asked the country’s highest court to intervene and take action against the law.

Opponents argue that these changes are unnecessary and are primarily fueled by personal and political grievances of Prime Minister Netanyahu, who is currently facing corruption charges. Critics also claim that these changes would disrupt the balance of power among the three branches of government.

In response to the planned changes, demonstrations have taken place, leading to roadblocks near parliament. Several companies, including gas stations, closed in protest ahead of the vote. Additionally, thousands of military reservists have declared their refusal to serve.

The leader of the opposition in parliament, Yair Lapid, has strongly criticized the law, calling it a complete breaking of the rules of the game. He stated, The government and coalition can choose what direction the state goes in, but it can’t decide the character of the state. Mr. Netanyahu’s supporters, on the other hand, gathered in central Tel Aviv to show their support for the proposed changes, while he criticized the military’s involvement in trying to influence the government’s decision.

The passing of this law comes after Prime Minister Netanyahu temporarily paused the overhaul in March due to pressure from protesters and labor strikes. However, with failed attempts to reach a compromise, he announced that his government would proceed with the overhaul.

U.S. President Joe Biden, whose party favors limiting the power of the U.S. Supreme Court, has voiced his opinion, urging Israel to form a consensus on the proposed changes. President Biden and Prime Minister Netanyahu also discussed the issue during a call in July.

Israeli President Isaac Herzog has acknowledged the gap between the parties and assured the public that officials are working diligently to find a solution. He called on elected officials to act with courage and reach out to foster understanding.

This recent development in Israeli politics has sparked widespread debate and divided opinions among the population. While some support the government’s efforts to reform the judiciary, others are concerned about the potential consequences and the impact on the country’s democratic principles. As the debate continues, the future of the Israeli Supreme Court and the balance of power within government hangs in the balance.
