The Indian government is accused of attempting to make the sedition law more extreme as they continue to use it to suppress and silence opposition leaders. The opposition party, Congress, states that the ruling BJP government has used the sedition law as a tool to subvert, subjugate, and silence dissent and questions why the government has not shown the courage to do away with the law, despite it being rendered inoperative by the Supreme Court. The Law Commission of India recently backed the penal provision for the offence of sedition, calling for the jail term for sedition cases to be increased from a minimum of three to seven years. Congress expressed concern at the rise in sedition cases since the current government came to power in 2014, stating that it indicates an attempt to curb criticism, restrict free speech and silence political opposition.
