Hong Kong Pro-Democracy Lawyer’s Solitary Confinement Sparks Outrage
International outrage continues to grow as prominent lawyer and pro-democracy activist Chow Hang-Tung faces relentless solitary confinement in Hong Kong. CIVICUS, a renowned global alliance dedicated to strengthening citizen action and civil society, has demanded the immediate cessation of this punitive practice against Chow.
CIVICUS has condemned the Hong Kong authorities for their persistent use of solitary confinement, calling for Chow’s unconditional release. The lawyer, who is also a human rights advocate, has been subjected to this form of punishment six times in the past four months, a clear violation of her rights and an oppressive suppression of free speech.
According to Rajavelu Karunanithi, CIVICUS Advocacy and Campaigns Officer for Asia, the repeated use of solitary confinement against Chow is unjust and goes against international laws. Karunanithi emphasizes that solitary confinement should only be used exceptionally, for the shortest time necessary, and with proper safeguards.
These punitive measures shed light on the escalating crackdown on human rights defenders in Hong Kong, particularly following the implementation of the draconian National Security Law (NSL). Chow’s most recent round of solitary confinement began on October 11, 2023, adding to the series of repressive actions she has endured.
Chow’s significant role in the Hong Kong Alliance in Support of Patriotic Democratic Movements of China further contributes to her plight. The alliance is well-known for organizing annual vigils commemorating the 1989 Tiananmen Massacre. In the past, Chow successfully appealed against a 15-month sentence for her literary expressions supporting participation in the 2021 Tiananmen vigil. However, she now faces ongoing trials and a 4.5-month imprisonment sentence for non-compliance under the NSL, highlighting the sweeping impact of the law on civic freedoms.
Adding to the concerns, the United Nations Working Group on Arbitrary Detention (UNWGAD) has identified Chow’s ongoing detention as retribution for her peaceful activism and outspoken political views. This observation aligns with CIVICUS Monitor’s 2023 assessment, which downgraded Hong Kong’s civic space status to ‘closed’ – the most critical classification.
CIVICUS’s statement underscores the dire situation in Hong Kong, where national security laws, sedition charges against activists, and attacks on press freedom contribute to an oppressive atmosphere. The organization highlights a troubling trend whereby civic groups face existential threats, leading to disbandment, relocation, or complete cessation of operations.
Karunanithi emphasizes the broader pattern of repression in Hong Kong, urging an end to all criminal proceedings against activists like Chow. He implores the international community to hold Hong Kong authorities accountable for the systematic erosion of fundamental human rights and civic freedoms.
