High-Profile Man Accused of Rape in Queensland Wins Court Injunction to Protect Identity

A well-known man charged with rape in Toowoomba, west of Brisbane, has obtained a court injunction to maintain his anonymity. The 28-year-old is facing two counts of rape, with the alleged offenses taking place in October 2021. However, new amendments to the Criminal Law (Sexual Offences) Act in Queensland could have revealed his identity from 12 am on Tuesday of next week. To ensure that the man’s statutory right to apply for an order to protect his identity was not rendered moot, Justice Applegarth granted the interim injunction sought by the legal team. The Queensland Police Service did not oppose this decision, as it would be contrary to the interests of justice to name the man before he had an opportunity to apply for a suppression order.

The legal amendments were put forward by the Women’s Safety and Justice Taskforce, which called for extensive reform of the criminal justice system to better support victims and survivors of sexual assault. The accused man was charged with the offenses in Toowoomba on January 10 of this year. Although he did not appear in person for his hearing, the court granted him bail on the condition that he abstains from contacting the complainant and surrenders his passport.
