HC removes Ayurvedic University Vice-Chancellor just before end of tenure

The Uttarakhand High Court has taken action against Dr. Sunil Joshi, the Vice-Chancellor of Uttarakhand Ayurved University, by dismissing him from his position. The dismissal was ordered on the grounds that Joshi did not possess the necessary qualifications for the role and his appointment violated the guidelines set by the University Grants Commission (UGC). Joshi’s tenure as Vice-Chancellor was set to end at the conclusion of this month, making the timing of this decision particularly impactful.

The decision was made by a division bench comprised of Chief Justice Vipin Sanghi and Justice Rakesh Thapliyal during the hearing of a petition that challenged Joshi’s appointment. The petitioner, Vinod Chauhan of Haridwar, argued that according to UGC norms, a minimum of 10 years of professorship is required for the appointment of a Vice-Chancellor, a qualification Joshi did not possess. The court had previously reserved the order after completing the hearing on this matter last month.

This decision is not an isolated incident, as it follows similar challenges to the appointments of Professor NS Bhandari as the Vice-Chancellor of SS Jeena University in Almora and CS Nautiyal as the Vice-Chancellor of Doon University. Bhandari resigned from his post in November 2021, just days before the verdict was issued against him, while Nautiyal was dismissed in December 2019.

Another Vice-Chancellor whose appointment is being challenged on similar grounds is Professor NK Joshi, currently serving as the Vice-Chancellor of Sri Dev Suman University. This matter is presently sub judice in the High Court.

This decision by the Uttarakhand High Court serves as a reminder of the importance of adhering to the necessary qualifications and guidelines when appointing individuals to leadership positions in educational institutions.
