AHMEDABAD: The Gujarat High Court has upheld the life imprisonment of former IPS officer Sanjiv Bhatt, who was convicted by a Jamnagar sessions court in connection with a death in custody that occurred in Jamjodhpur town in 1990. The decision also maintains the life term for retired constable Pravinsinh Zala, who was found guilty of murder in the same case.
Bhatt is currently facing criminal charges related to allegedly fabricating evidence to frame PM Modi, the then CM of Gujarat, and others in connection with the conspiracy behind the violence triggered by the Godhra train burning in 2002.
The High Court’s ruling dismisses Bhatt’s appeal against his conviction and confirms the life imprisonment for Zala. Additionally, the court upholds the convictions of five other policemen involved in the case – sub-inspectors Deepak Shah and Shailesh Pandya, and constables Pravinsinh Jethva, Anopsinh Jethva, and Keshubha Jadeja.
The High Court also revoked the bail of the five convicted policemen and rejected the state government’s appeal for an enhancement in their punishment. They were found guilty of torture in custody, resulting in a two-year jail term and a fine of Rs 10,000.
The case dates back to October 30, 1990, when Bhatt was serving as an assistant SP in the area. He faced allegations related to the death of detainee Prabhudas Vaishnani in custody.
This decision by the Gujarat High Court marks a significant development in the legal proceedings against Bhatt and his co-accused. The affirmation of their life sentences underscores the gravity of their crimes and sends a strong message regarding the accountability of law enforcement officials.
The verdict has received mixed reactions from various quarters. Supporters of Bhatt have expressed disappointment and argue that he has been targeted for his activism and willingness to stand up against powerful figures. On the other hand, those who believe in the criminal justice system applaud the court’s decision to uphold the convictions and sentences, viewing it as a step towards justice for the victim and his family.
While Bhatt and Zala have been in custody since their conviction in June 2019, their legal battles are far from over. Bhatt’s involvement in high-profile cases, including the one related to Prime Minister Modi, has drawn significant attention and controversy. The outcome of these ongoing cases will have far-reaching implications not only for the individuals involved but also for the larger discourse surrounding accountability and justice in India.
As the legal proceedings continue, the focus remains on ensuring a fair and transparent justice system that upholds the rule of law. The Gujarat High Court’s decision in this case serves as a reminder that no one is above the law, and those found guilty of serious crimes will face appropriate consequences.
The path forward for Bhatt and his co-accused is uncertain, but what remains clear is the importance of our justice system in maintaining accountability and delivering justice for all. As the legal battles unfold, the eyes of the nation will remain fixed on the outcomes, seeking an equitable resolution and closure for the victim’s family.
