Gujarat HC Slams GPSC’s Gender Insensitivity Over Postpartum Candidate, India

AHMEDABAD: The Gujarat High Court has sharply criticized the state public service commission (GPSC) for its absolute gender insensitivity in refusing a candidate’s request to either postpone her interview or provide an alternative solution. The candidate, who had recently given birth, was unable to appear for the interview just two days after delivering a baby. The court, presided over by Justice Nikhil Kariel, expressed the need for intervention in the case and issued a notice to GPSC.

The court also directed the commission not to declare the results of the interview for the position of assistant manager (finance and accounts) Class II, which the woman had applied for.

In its order dated January 9, the court observed, The grievance raised in the petition reflects the absolute gender insensitivity of the respondents towards one of the most sacred natural processes i.e. of giving birth to a child.

The petitioner had successfully cleared the written exam for the post advertised by GPSC in 2020. On December 18, 2023, she was informed about the interview dates on January 1 or 2, 2024. Realizing that her due date was in the first week of January 2024, the petitioner sent an email to GPSC on the same day, explaining her pregnancy and stating that it would be impossible for her to travel nearly 300km to Gandhinagar in the advanced stage of pregnancy.

Subsequently, the petitioner gave birth on December 31, 2023, and promptly informed GPSC via an email, requesting either a postponement of the interview or an alternative solution.

However, GPSC responded by asking the petitioner to attend the interview on January 2 and reiterated that no further time would be granted to her.

The court emphasized that when the candidate made a reasonable request, GPSC should have either postponed the interview process or offered an alternative solution, such as conducting an online interview if permitted by rules. Additionally, the court noted that the selection process was not progressing at an exceptionally fast pace.

This incident highlights the need for gender sensitivity and compassion towards women who have undergone childbirth, especially during crucial life events such as job interviews. It is important for organizations to accommodate these circumstances and ensure equality for all candidates, regardless of gender.

The court’s intervention in this case sets a precedent for recognizing the unique challenges faced by women after childbirth and underscores the importance of establishing policies that reflect gender sensitivity.
