Government Mandates Pre-Approval for AI Products in India

In an unprecedented move, the Ministry of Electronics and Information Technology (Meity) has laid down the law for artificial intelligence (AI) platforms and social media intermediaries in India. On Friday, Meity issued a comprehensive advisory mandating AI platforms and social media intermediaries to secure permission prior to launching AI products in the country. This directive aims to mitigate biases that might affect the electoral process and maintain the sanctity of India’s democratic fabric.

Generative AI platforms cannot shirk responsibility by claiming their technology is under testing, remarked Rajeev Chandrasekhar, Minister of State for Electronics. This statement underscores the government’s stance on accountability in the digital domain, particularly concerning AI’s potential impact on public discourse and national interests.

The advisory further mandates platforms to ensure transparency concerning AI-generated content. With the recent criticism of Google’s AI tool, Gemini, for biased responses towards Prime Minister Narendra Modi, the necessity for unbiased AI technology has never been more apparent. Platforms are now required to embed unique metadata or identifiers in synthetically created content, facilitating the traceability of misinformation and its origin.

Failure to comply with these directives could result in legal consequences under the IT Act and other relevant criminal statutes, highlighting the seriousness with which the government views this issue.

The advisory does not just serve as a set of guidelines but as a harbinger of future regulatory frameworks aimed at fostering a safe and trusted internet ecosystem. It delineates clear expectations for AI startups and digital platforms, emphasizing the need for a balance between innovation and societal impact.

For AI platforms under testing wishing to create a sandbox environment on the internet, obtaining government permission is now a prerequisite. This move not only seeks to protect public interest but also to inform users about the possible and inherent fallibility or unreliability of AI outputs through consent popups.
