Former New York City Police Commissioner Bernard Kerik was questioned by special counsel Jack Smith’s team for five hours on Monday as part of the investigation into efforts to overturn the results of the 2020 election. Kerik, who served as police commissioner under Rudy Giuliani when he was mayor of New York City, collaborated with Giuliani in their attempt to prove allegations of election fraud in seven states.
Despite the claims made by former President Donald Trump and his allies, numerous lawsuits challenging the election outcome were dismissed by state and federal judges, and every state certified its election results. Kerik handed over thousands of pages of records to the special counsel before Trump was indicted last week for his alleged involvement in trying to overturn the election. Trump has pleaded not guilty to all charges.
The indictment also mentioned six unnamed co-conspirators who allegedly worked with Trump to impede the transfer of power to President Biden. Giuliani’s attorney, Robert Costello, stated that co-conspirator 1 in the indictment is likely Giuliani, as the description of the person aligns with Giuliani’s role as an attorney willing to spread knowingly false claims and pursue strategies that Trump’s reelection campaign attorneys would not endorse.
During Kerik’s interview with investigators, the focus was on Giuliani’s investigation into election fraud and the composition of his team. The investigators particularly emphasized the role of Trump’s political action committee and the lack of funding it provided for Giuliani’s efforts. Kerik explained that additional funding could have helped assess the credibility of the fraud allegations more thoroughly.
The interview between Kerik and the investigators was described as friendly and productive by his lawyer, Tim Parlatore.
