Former All Blacks and International Rugby Players Sue Governing Bodies Over Brain Injuries, New Zealand

Former All Blacks Carl Hayman and Regan King are among more than 200 players who have filed a lawsuit against World Rugby, the Rugby Football Union (RFU), and the Welsh Rugby Union (WRU) over neurological injuries. Over 300 former players have taken legal action, claiming that brain injuries sustained during their careers have led to debilitating symptoms. The Royal Courts of Justice partially lifted an anonymity order, revealing the names of 226 claimants. The list includes other prominent players such as Inoke Afeaki, Tevita Taumoepeau, Vaughan Going, as well as members of England’s 2003 World Cup-winning squad.

Carl Hayman, a former tighthead prop who played 45 tests for the All Blacks, has disclosed that he is struggling with dementia and chronic traumatic encephalopathy (CTE). Hayman initially dismissed his symptoms of short-term memory loss, headaches, and insomnia, only to later receive a diagnosis of brain injury and dementia. Since speaking publicly about his health issues, Hayman has been contacted by numerous players who have also experienced head injuries.

Three members of England’s 2003 World Cup-winning squad, including Steve Thompson, Phil Vickery, and Mark Regan, have also taken legal action. Thompson, who has been diagnosed with early-onset dementia and has no memory of the memorable 2003 final against Australia, highlighted the importance of player welfare. Similarly, other notable players involved in the lawsuit include former Welsh captains Ryan Jones and Colin Charvis, as well as Scotland’s Sean Lamont, who earned over 100 caps for his country.

The players argue that the rugby authorities failed in their duty of care by not implementing reasonable measures to protect their health and safety. However, World Rugby, the RFU, and the WRU have rejected these claims. A joint statement from the three bodies emphasized their commitment to player welfare and their dedication to leading the welfare agenda in sport.

The legal process has faced delays, as establishing a group litigation order was denied at a case management hearing in the Royal Courts of Justice. The defendants have requested access to detailed medical records for all players involved, including information related to diagnosis and symptoms consistent with brain injuries. The case represents players from ten countries, with the youngest listed claimant being 22-year-old Joseph Cook.

While the lawsuit progresses, the focus remains on the players and their well-being. The claims shed light on the importance of prioritizing player welfare across all levels of rugby and ensuring that appropriate measures are in place to safeguard their health and safety.
