EU Commission Monitors Impact of Emerging Technologies on Creative Professions

The European Commission acknowledges the influence of emerging technologies on creative professions and is actively monitoring their progress, as indicated in the European Media Industry Outlook. While these technologies present new business opportunities, they also pose potential threats to certain professions.

To address this concern, the Commission has initiated a dialogue with stakeholders in the audiovisual industry to discuss key issues related to innovation and the impact of new technologies. In that regard, the use of artificial intelligence (AI) in film-making will be a central point of discussion, with actors’ representatives being invited to participate in dedicated meetings.

In 2021, the Commission introduced the AI Act, which aims to address potential risks associated with AI deployment while maximizing its benefits. The act seeks to ensure safety, protect fundamental rights, and promote trustworthy AI across the EU.

Under the proposed legislation, AI systems that pose high risks to fundamental rights will be subject to strict requirements aimed at mitigating these risks before they can be used in the EU. Regarding actors, EU copyright law grants performers exclusive rights to authorize or prohibit the use of their performances. When transferring or licensing these rights to producers, performers are entitled to receive appropriate and proportionate remuneration. This ensures fair compensation for their contributions.

In situations where an artist’s scanned image is unlawfully used, the EU’s robust data protection rules can offer protection. Furthermore, artists can explore the laws of individual Member States relating to the safeguarding of personality rights.

As emerging technologies continue to shape the landscape of creative professions, the European Commission remains committed to recognizing and addressing their impact. By engaging with stakeholders, promoting trustworthy AI, and safeguarding performers’ rights, the Commission aims to foster a competitive and secure environment for the audiovisual industry.
