Driver Sentenced to 3 Years for Reckless Homicide in Fatal Crash

ALBUQUERQUE, N.M. – A driver has been sentenced to three years in jail for reckless homicide in a fatal crash that claimed the life of Michael Chmura. The incident occurred two years ago on 4th Street near Candelaira when Chmura was struck by a truck driven by Kyle Atencio-Crespin.

According to witnesses, Atencio-Crespin was driving erratically at the time of the accident. He claimed to have put his truck on cruise control, traveling at a speed of 45 mph. However, officers suspected that he was under the influence of substances, as he had marijuana in his system and showed signs of impairment.

Originally charged with a DWI, Atencio-Crespin pleaded guilty to a lesser charge of homicide by reckless driving. His defense lawyer, Ahmad Assed, explained that they pursued this plea deal due to a lack of evidence supporting the DWI charge.

Despite Atencio-Crespin’s history of DWI charges, the judge considered various factors before delivering the sentencing. Testimony was heard from family members of both Chmura and Atencio-Crespin, as well as from Atencio-Crespin himself.
