Dell Australia Fined AUD10 Million for Misleading Customers on Monitor Discount Prices
Consumer electronics giant Dell’s Australia division has been hit with a hefty AUD10 million ($6.49 million) fine by the Federal Court for deceptive conduct related to the sale of monitors at discounted prices. The court ruled against Dell Australia Pvt Ltd following enforcement proceedings initiated by the Australian Competition and Consumer Commission (ACCC), which accused the company of making false and misleading representations on its website regarding discount prices for add-on computer monitors.
According to the ACCC, Dell Australia admitted to misleading customers about the price of a range of monitors that were available as part of a bundle offer with the purchase of a desktop, laptop, or notebook. These monitors were often advertised with a higher ‘strikethrough’ price, giving the impression of significant savings if purchased alongside other computer products. In reality, however, consumers frequently ended up paying more than if they had bought the monitors as standalone items.
The regulator revealed that over 5,300 monitors were sold to consumers with overstated discounts. Dell Australia further confessed to misleading customers with various claims such as Total Savings, Includes x percent off, Discounted Price, and Get the best price for popular accessories when purchased with this product.
ACCC Commissioner Liza Carver emphasized the significance of the outcome, stating, This outcome sends a strong message to businesses that making false representations about prices or inflating discounts is a serious breach of consumer law and will attract substantial penalties. Carver also stressed the importance of businesses being cautious when advertising discount pricing to ensure they do not mislead consumers with regards to the savings on offer.
Earlier this year, the court ordered Dell Australia to compensate affected consumers by offering refunds and issuing corrective notices. The company was also directed to review its compliance program and contribute to the ACCC’s costs.
In response to the ruling, a spokesperson for Dell stated that the company is taking action to enhance its pricing processes and prevent similar errors in the future. The spokesperson expressed relief that the issue has been resolved and reiterated Dell’s commitment to serving its Australian customers.
