The Delhi High Court has taken suo motu action against the sale of expired food products by re-packaging, issuing notices to the relevant authorities. Acting Chief Justice Manmohan, along with Justice Manmeet Pritam Singh Arora, has initiated a public interest litigation after a single judge’s order revealed a coordinated mechanism for re-packaging expired products with new expiry dates. The court has appointed Shwetasree Mazumdar as Amicus Curiae in the matter. The case came to light during a civil suit filed by The Hershey Company, a renowned chocolate company, against Defendant Atul Jalan for selling expired chocolates under their brand name. The court found that the defendant had deliberately copied the plaintiff’s mark and packaging, misrepresenting expired and counterfeit chocolates as genuine Hershey products. The matter has been listed for hearing on February 8, 2024.
