Delays and Rejections: Urgent Call to Prioritize Immigration Practices for Skilled Foreigners in SA

In a nation as diverse and dynamic as South Africa, the potential for growth and development lies in embracing skilled foreigners and fostering a welcoming environment for them.

Recently, concerns have been raised about the delays, rejections, and unnecessary complexities in the visa application process. As stakeholders in immigration and passionate citizens, we feel compelled to urge the Minister of Home Affairs to prioritize the welfare of South Africa through progressive immigration practices.

An article on SABC news on July 12 shed light on the challenges faced by applicants seeking permanent residence and visas based on retirement or net worth. It is deeply disheartening to witness the delays and rejections experienced by these individuals, including our clients. Many applications are rejected for trivial and misguided reasons, such as the inability to contact banks for verification or considering applications incomplete when they are fully compliant.

The insistence on documents that surpass the legal requirements and using them as grounds for rejection is unacceptable. Home Affairs should adopt a more reasonable approach by requesting additional documents through direct communication with the applicants or their legal representatives.

This approach would allow applicants to address any queries or uncertainties raised, fostering an environment of cooperation and facilitating effective communication between all parties involved. Ultimately, it would work towards the common goal of accurately verifying qualifications and documentation.

Another issue that needs attention is the exclusion of visa applicants who filed their applications after March 2023 from the new blanket waiver, which expires at the end of December 2023. By implementing such exclusions, the Minister has further exacerbated the delays in processing.

Consequently, many foreigners find themselves in a precarious situation, where they are forced to overstay their visas unknowingly, becoming illegal residents and facing potential bans on re-entering the country. This fate often befalls short-term visa applicants.

These tourists and temporary residents are not burdens but rather vital contributors to South Africa’s prosperity. Instead of turning them away and causing them undue hardship, we should welcome and encourage their presence. These visitors should have the necessary support and care while their applications are being processed, as they have fulfilled all the legal requirements to extend their stay and continue contributing to our economy.

The callous response from a high-ranking Home Affairs official overseeing visa and permitting matters, suggesting that visitors should leave the country if their applications are not processed before their visas expire, is deeply concerning.

It is crucial for the Minister of Home Affairs to consider these issues seriously and enact necessary changes to streamline and prioritize immigration practices for skilled foreigners. By doing so, South Africa can harness the potential of these individuals and create an inclusive and favorable environment that promotes growth, development, and cooperation.

Let us work together towards a South Africa that embraces diversity, values skilled foreigners, and offers a warm welcome to those who wish to contribute to our nation’s progress.
