Title: Investigation Finds Law Enforcement Actions in Man’s Fatal Shooting Were Deemed Lawful
In a recent statement, the Rowan County district attorney revealed that the N.C. State Bureau of Investigation (SBI) has concluded their investigation into a fatal shooting, declaring that the actions taken by law enforcement were lawful. The incident, which occurred in February, resulted in the death of Jordan Mays during the execution of a warrant.
According to the released statement, the investigation determined that the deputy involved in the incident acted lawfully and did not violate any criminal laws when they discharged their weapon, resulting in the tragic loss of Mays’ life. The events took place at a residence located outside the city limits of Salisbury, North Carolina, after the Sheriff’s Office Criminal Apprehension Team (SOCAT) received information that both Mays and another individual with outstanding warrants, Jeremy Brock, were present at the address.
The shooting transpired shortly after 5 p.m. on that fateful day. The statement from Rowan County District Attorney Brandy Cook provided a comprehensive summary of the investigation, which included testimonies from witnesses and law enforcement deputies, as well as crime scene investigation notes and photographs.
Based on the gathered evidence and witness testimonies, it was revealed that the presence of multiple firearms in the room where Mays was located, coupled with his lack of cooperation with the deputies’ commands, ultimately led to the use of deadly force. The firearms found at the scene included a Taurus slim 9mm handgun, a black Glock 26 Gen 4 9mm handgun, and a Taurus PT-92 C 9 mm handgun.
The statement elaborated on the legal standard analysis, affirming that law enforcement officers, or any person for that matter, are justified in using deadly force if they reasonably believe that there is an imminent danger of great bodily harm or death to themselves or another person. In their efforts to repel a potential deadly attack, law enforcement officers are legally permitted to take action before it is too late.
According to the release, after deputies arrived at the residence, they issued multiple commands for Mays to exit the premises. Upon entering the room where Mays was located, deputies again instructed him to come out with his hands raised. However, Mays reportedly failed to comply with these commands, leading to a confrontation between him and one of the deputies attempting to take him into custody.
During the struggle, it was established that Mays made a move towards one of the visible firearms in the room, prompting the deputies to issue warnings against reaching for the weapon. Unfortunately, Mays persisted in his non-compliance, ultimately resulting in the discharge of fatal shots.
The investigation’s conclusion, as outlined by the district attorney, emphasized the importance of prompt action to thwart a potentially lethal attack. It also highlighted that, under North Carolina law, the burden of proof rests with the state to demonstrate beyond a reasonable doubt that a person did not act in self-defense.
The incident has brought attention to the complexities faced by law enforcement officers in high-pressure situations that require split-second decision making. Nevertheless, the determination of the investigation, backed by witness statements and evidence, has corroborated the lawful actions of the deputy involved.
The district attorney’s statement serves to provide transparency and ensure accountability by offering a detailed account of the investigation, shedding light on the circumstances that led to the unfortunate loss of life. It is hoped that this comprehensive review will bring closure to those affected by the tragic events of that day and foster trust between law enforcement and the community.
While this investigation has concluded, it is crucial for society to continue engaging in constructive conversations about police practices, the use of force, and how to strike the delicate balance between public safety and individual rights. By fostering dialogue and seeking ways to improve law enforcement policies and practices, we can work towards a safer and more just society for all.
