Court Blocks Ruling Allowing Biden Administration to Require Social Media Censorship

The Biden administration has received a temporary victory as a federal appeals court has granted a hold on a previous ruling that prevented federal agencies from requesting social media companies to censor constitutionally protected free speech. The 5th Circuit Court of Appeals in New Orleans agreed to put a temporary administrative stay on the ban until the case is referred to a different appeals panel for further deliberation.

The ruling came after Louisiana and Missouri filed a censorship-by-proxy lawsuit against Biden administration agencies and top officials. The lawsuit claimed that federal agencies and senior staff members were pressuring social media companies to censor Americans’ free speech. In a July 4 ruling, Judge Terry A. Doughty of the U.S. District Court for the Western District of Louisiana issued an injunction prohibiting the agencies and their staff from engaging in any communication with social media companies that would lead to the removal or suppression of protected free speech content.

However, Judge Doughty did include exceptions in his order. Government officials are still allowed to contact social media companies to report criminal activity or threats to national security. They can also communicate with the companies about posts intending to mislead voters or suppress posts that are not protected free speech.

The Department of Justice (DOJ) immediately filed an appeal to overturn the social media contact ban, arguing that the injunction was too broad. The DOJ claimed that the ban could hinder law enforcement activities online. But Judge Doughty denied the DOJ’s request to stay his initial ruling. The Biden administration’s lawyers then filed an emergency stay of the injunction at the 5th U.S. District Court of Appeals, arguing that the ruling was too vague and broad.

The recent decision by the appeals court grants a temporary administrative stay against Judge Doughty’s injunction. The stay will remain in place until a different appeals panel reviews the case and deliberates on the merits of the ruling. The Department of Justice declined to comment on the decision.

Louisiana Attorney General Jeff Landry, one of the plaintiffs in the lawsuit, stated that this case could be one of the most significant First Amendment cases in modern history. He believes that the evidence presented during the case showcases the federal government’s massive undertaking to limit American speech. Landry finds the revelations concerning and alarming for all Americans.

The court’s decision temporarily allows the Biden administration to continue communicating with social media companies regarding content moderation. However, the ultimate outcome of the case will determine whether federal agencies can pressure social media companies to censor constitutionally protected free speech. The appeals panel will thoroughly consider the merits of the earlier ruling in due course.
