Confidential Crime Scene Evidence Leak Threatens Delphi Murder Trial
A hearing has been scheduled to address the alleged leak of confidential Delphi crime scene evidence by accused child killer Richard Allen’s defense team, which could potentially jeopardize his trial, scheduled for next year.
Special Judge Fran Gull has ordered a hearing on October 19 to discuss the upcoming hearing on October 31, 2023, as well as other matters that have recently arisen. These other matters likely refer to crime scene evidence that has been shared online in connection with the 2017 Delphi murders of Abigail Williams, 13, and Libby German, 14.
An investigation by The Murder Sheet podcast suggests that Allen’s lawyers may be responsible for releasing sensitive images to social media groups focused on the murders. This development has raised concerns as it could compromise the fairness and integrity of the trial.
This is not the first time that Allen’s defense team has come under scrutiny. In December 2022, lawyers Andrew Baldwin and Bradley Rozzi were reprimanded by Judge Gull after publicly denouncing the case against Allen shortly after taking on the defense. As a result, a gag order was imposed on all parties involved.
In September, the defense further escalated tensions by accusing the state of withholding evidence and deceiving the judge to obtain a search warrant for Allen’s home. These actions have drawn repeated chastisement from Judge Gull, who has voiced concerns about statements and leaks jeopardizing Allen’s right to a fair trial.
Richard Allen was taken into custody on October 28, 2022, at his home in Delphi, by the Delphi Double Homicide Task Force for the murders of Abigail and Libby. The victims were found murdered near the Monon High Bridge on February 14, 2017, after a short outing. When the girls failed to return, their families contacted the police.
During the search of Allen’s residence, investigators discovered incriminating evidence, including a bullet found at the crime scene that forensically matched Allen’s registered firearm. Allen claimed he had never allowed anyone else to use his gun, but he had no explanation when informed that a bullet from his firearm was found at the crime scene.
The leaked crime scene evidence poses significant challenges for the upcoming trial. The unauthorized release of sensitive images compromises the integrity of the proceedings and raises questions about potential biases that may have been formed as a result.
