California Governor Gavin Newsom has signed a new law requiring all K-12 schools in the state to provide gender-neutral bathrooms by July 2026, according to CNN. The law, known as Senate Bill 760, is part of a series of legislations signed by Newsom to expand protections for California’s LGBTQ community.
The law stipulates that every school district, county office of education, and charter school must have at least one gender-neutral bathroom on campus by July 1, 2026. These bathrooms should be accessible during school hours and events when students are present. Temporary closures are only permitted in cases of documented safety concerns, immediate threats to student safety, or for necessary repairs.
To comply with state law, gender-neutral bathrooms must have visible signage indicating that they are open to all genders. Schools are also required to designate a staff member responsible for ensuring compliance with the law. This move aims to address the challenges faced by transgender and non-binary students who often struggle to find appropriate bathroom facilities. A recent study by the Human Rights Campaign revealed that 43% of transgender and non-binary students have never been able to use a bathroom or locker room that aligns with their gender identity, while 38% have reported a lack of suitable facilities or options.
State Senator Josh Newman, who sponsored the law, praised Newsom’s actions, believing that it is only fair for students to have access to restrooms without fear of discrimination or stigma. He hopes that California’s groundbreaking legislation will serve as a model for other states in protecting the rights and safety of children.
Equality California, an LGBTQ civil rights group, applauded the governor’s decision, emphasizing that it sends a clear message that the state will protect the rights of the LGBTQ community. The organization’s executive director, Tony Hoang, reiterated that hate-filled attacks will not be tolerated, and California remains committed to ensuring the safety and well-being of all LGBTQ individuals.
