Australia Launches Inquiry to Improve Justice Responses to Sexual Violence

The Australian Government has tasked the Australian Law Reform Commission (ALRC) with conducting an inquiry into justice responses to sexual violence. This move is part of a $14.7 million budget commitment aimed at improving the experiences of victims and survivors of sexual violence within the criminal justice system. The Hon Marcia Neave AO and Her Honour Judge Liesl Kudelka of the District Court of South Australia have been appointed as part-time Commissioners to lead the inquiry, bringing significant expertise in law reform and justice responses to sexual violence.

The primary objective of the inquiry is to explore ways to enhance the experiences of victims and survivors within the justice system. This will be achieved by analyzing relevant laws and legal frameworks, justice sector practices, support systems for victims and survivors, and transformative approaches to justice. The goal is to prevent further harm to victims throughout the justice process.

According to Attorney-General Mark Dreyfus, victims and survivors often encounter additional trauma when seeking justice. The inquiry aims to address this issue by identifying ways to improve their experiences within the justice system. Minister for Women, Senator Katy Gallagher, emphasized the need to strengthen sexual assault laws and improve outcomes for victims and survivors.

The Australian Government’s commitment to ending family, domestic, and sexual violence is demonstrated through its $2.3 billion investment in this area. The National Plan to End Violence Against Women and Children acknowledges sexual violence as a significant concern. To ensure the lived experiences of victims and survivors are deeply considered, the Government has formed a sexual violence lived-experience Expert Advisory Group (EAG). This group will collaborate closely with the ALRC to inform the inquiry’s findings and advise the Government on implementing the recommendations.

The ALRC inquiry and the EAG play crucial roles in improving access to justice for victims and survivors of sexual violence, aligning with the National Plan to End Violence against Women and Children 2022-2032. The Government expressed gratitude towards those who attended the national roundtable on justice responses to sexual violence and the individuals who courageously shared their experiences. The ALRC is expected to present its findings by January 22, 2025.

Ms. Neave and Judge Kudelka, the appointed Commissioners, possess extensive expertise in the field. Ms. Neave is an Officer of the Order of Australia, with experience as a judge, commissioner, public policy maker, and academic. Judge Kudelka has worked as a judge, counsel, and prosecutor for over 25 years, including handling cases involving victims of sexual violence.

The Australian Law Reform Commission’s inquiry into justice responses to sexual violence is a significant step towards improving the experiences of victims and survivors within the justice system. By addressing existing laws, practices, and support systems, the Government aims to create a more compassionate and effective path to justice for those affected by sexual violence.
