Army Major Found Guilty of Sexual Assault on 11-Year-Old, Faces Dishonorable Dismissal

In a disturbing case that has shocked the nation, an Army Major from the Corps of Army Air Defense has been convicted of sexually assaulting an 11-year-old girl. The officer, who was stationed in New Delhi at the time of the offense, now faces dishonorable dismissal from the service.

The Major was charged with two offenses under Section 69 of the Army Act, along with relevant provisions of the Protection of Children from Sexual Offenses (POCSO) Act 2012. The prosecution argued that the charges had been well proved and emphasized that the accused and his family were educated and fully aware of the gravity of the crime committed.

The incident came to light when the daughter of the domestic help accused the Major of sexual assault. The victim’s mother lodged an official complaint in January 2022 with the Army authorities at the Station Headquarters in Delhi Cantonment. Prompt action was taken, and a Court of Inquiry (COI) was ordered to investigate the matter.

The COI, conducted by the HQ 715 (Independent) Air Defense Brigade, found sufficient evidence to support the charges against the Major. However, the defense lawyer, Advocate Anand Kumar, raised concerns about inconsistencies in the case. Kumar pointed out that there was a delay in filing the complaint and questioned the authenticity of the tampered complaint copy, which lacked any signature or official stamp.

Furthermore, the defense argued that the statements of the complainant, the survivor, and her father were changed in the COI and Summary of Evidence (SOE). They requested the summoning of the officer responsible for recording the SOE but were denied. The defense believed that these discrepancies prejudiced their case.

The General Court Martial (GCM) proceedings were presided over by Colonel Rajesh Dhaiya, with the involvement of two senior members and a woman officer as the Judge Advocate. The GCM found the Major guilty of the charges, and he now faces dishonorable dismissal from the service, commonly known as cashiering. This means he will not be entitled to any military benefits following his conviction.

Sexual assault is a heinous crime that must be condemned in the strongest terms.
