CPIM Leader Warns Supreme Court: Abrogation of Article 370 Threatens India’s Foundations

The abrogation of Article 370 in Jammu and Kashmir is not only an assault on the rights of its people, but also on the foundations of India itself, warned CPI(M) leader M Y Tarigami. He expressed concern that if the Supreme Court does not intervene and stop the unconstitutional move by the central government, it will have far-reaching implications.

Speaking at a press conference, Tarigami emphasized the weightage of the arguments presented by the lawyers of the petitioners. He referred to the revocation of Article 370 on August 5, 2019, as unconstitutional and a mockery of the Indian Constitution. Tarigami stressed that the assault was not limited to Jammu and Kashmir alone, but rather an assault on the very essence of the Indian republic. He expressed his apprehensions regarding the profound implications that may arise if the Supreme Court does not halt this unconstitutional act.

Tarigami noted that Jammu and Kashmir holds a unique position as it negotiated the terms of its accession to the Union of India, a privilege not extended to any other state. He pointed out that those claiming Article 370 to be temporary overlook the fact that it can only be abrogated with the approval of the constituent assembly of Jammu and Kashmir, not the assembly or the governor.

The petitioners are hopeful that the Supreme Court will deliver justice and protect the safeguards and rights provided by the Indian Constitution to the people of Jammu and Kashmir. Tarigami clarified that their appeal seeks only what has been enshrined in the Constitution.

In conclusion, the abrogation of Article 370 not only infringes upon the rights of the people of Jammu and Kashmir but also challenges the very foundations of India. The Supreme Court’s intervention is eagerly awaited by the petitioners, with the hope that justice will prevail and the constitutional safeguards will be upheld.
