Delhi Police Criticized for Incomplete Investigation in 2020 Delhi Riots Case
In a recent development in the case related to the 2020 Delhi riots, a sessions court has slammed the Delhi Police for their incomplete investigation and improper filing of chargesheets. The court discharged three individuals who were charged with rioting and criminal conspiracy, citing suspicions that the investigating officer manipulated the evidence without conducting a thorough investigation.
The court found inconsistencies in the chargesheets and subsequent statements, indicating an attempt to cover up flaws in the prosecution’s case. One of the glaring discrepancies was the inclusion of three individuals as accused in the first supplementary chargesheet, despite their names not being mentioned in a constable’s statement. The investigating officer failed to provide any evidence to support these subsequent statements.
Furthermore, the court pointed out that the statements of the complainants were recorded solely to justify the chargesheeting of the accused, rather than to accurately represent the reported incidents. The judge also highlighted a conflict between two sets of relied-upon evidence concerning the date and time of the alleged incidents.
The case stemmed from an FIR registered at Dayalpur police station in February 2020, based on a complaint prepared by an Assistant Sub-Inspector. Subsequently, complaints from four individuals were combined, resulting in the filing of a chargesheet and subsequent cognisance. Two supplementary chargesheets were filed later, along with fresh statements and documents.
The court has now referred the matter back to the police, urging them to reassess the investigation and take appropriate action in accordance with the law. The discharged trio had been charged under relevant sections of the Indian Penal Code (IPC).
