PNM’s Unopposed Joint Motion for Abeyance and Remand Seeks Final Resolution in New Mexico Energy Matter
Public Service Company of New Mexico (PNM), along with several intervenors, namely New Mexico Office of the Attorney General (NMAG), Western Resource Advocates (WRA), New Energy Economy (NEE), New Mexico Affordable Reliable Energy Alliance (NM AREA), Coalition for Clean Affordable Energy (CCAE), and Prosperity Works, have jointly filed a motion for abeyance and remand. The motion seeks a definitive resolution in the New Mexico energy matter, and is now before the court for consideration.
The joint movants, represented by PNM, would like the court to temporarily suspend this appeal and remand the case back to the New Mexico Public Regulation Commission (Commission) for further proceedings in line with the settlement agreement and proposed settlement final order. If the remand is granted, the unanimous settlement proposal will be brought before the Commission for deliberation during their open meeting process. It is essential to note that the Commission has no stance on this motion.
The primary objective of the joint motion is to achieve a final and unappealable resolution of all the issues under consideration. Once the Commission reaches a resolution based on the joint movants’ settlement agreement, PNM and the intervenor-appellees intend to file a stipulated dismissal of the appeal. This approach is in accordance with Rule 12-401(B)(1) NMRA.
The joint movants firmly believe that this motion, if approved, will provide an opportunity for comprehensive deliberation within the Commission and ultimately lead to a conclusive decision on the matters at hand. The attached settlement agreement (Exhibit A) and proposed settlement final order (Exhibit B) outline the terms and conditions that the joint movants seek to be implemented.
It is worth mentioning that by adhering to the open meeting process of the Commission, all stakeholders will have the opportunity to express their views and opinions on the settlement proposal. This ensures a fair and transparent environment for deliberation. Additionally, inviting input from various parties will present a balanced view and allow for a thorough examination of the proposed resolution.
In conclusion, PNM, along with the intervenors, has submitted an unopposed joint motion for abeyance and remand with the aim of obtaining a final resolution in the New Mexico energy matter. The parties involved request that the court temporarily halt the appeal and remand the case back to the Commission for further proceedings. If successful, the resolution reached by the Commission will prompt the dismissal of the appeal, providing a conclusive end to the ongoing matters.
